1. Agreement to Terms

By accessing or using EasyPEPCheck ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and EasyPEPCheck regarding your use of our PEP and sanctions screening service.

2. Description of Service

EasyPEPCheck provides a screening service that allows users to check names against:

  • Official sanctions lists (EU, OFAC, UN, UK)
  • Politically Exposed Persons (PEP) databases

The Service generates screening results and downloadable PDF reports for compliance documentation purposes.

3. Important Disclaimer

EasyPEPCheck is a compliance assistance tool, NOT a decision-making service.

  • The Service provides information to assist with your compliance obligations
  • The final decision and responsibility for any compliance determination remains entirely with you
  • We do not provide legal, financial, or regulatory advice
  • You should consult qualified professionals for compliance decisions

4. User Accounts

4.1 Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated tools to scrape or extract data from the Service
  • Resell or redistribute the Service without authorization
  • Use the Service to harass, discriminate, or harm individuals
  • Submit false or misleading information

6. Pricing and Payment

6.1 Subscription Plans

The Service offers various subscription plans as described on our pricing page. Prices are in Euros and exclude applicable taxes.

6.2 Credits

Each screening consumes one credit. Credits are allocated based on your subscription plan and reset monthly. Unused credits do not roll over to the next billing period.

6.3 Billing

Subscriptions are billed in advance on a monthly basis. Payment is processed through Stripe. You authorize us to charge your payment method for all fees incurred.

6.4 Refunds

Subscription fees are non-refundable except as required by law. If you cancel your subscription, you will retain access until the end of the current billing period.

7. Data Sources and Accuracy

7.1 Data Sources

We use official, publicly available data sources including EU sanctions lists, OFAC SDN, UN sanctions, UK sanctions, and PEP databases. Lists are updated twice daily.

7.2 No Guarantee of Completeness

While we strive for accuracy, we cannot guarantee that our data is complete, current, or error-free. You should verify critical matches through official sources.

7.3 Matching Methodology

Our matching uses fuzzy string matching algorithms. A "match" indicates a potential correspondence that requires your review and verification. False positives may occur.

8. Intellectual Property

The Service, including its design, features, and content, is owned by EasyPEPCheck and protected by intellectual property laws. You may not copy, modify, or create derivative works without our permission.

You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" without warranties of any kind
  • We disclaim all implied warranties, including merchantability and fitness for a particular purpose
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for any regulatory penalties, fines, or enforcement actions you may face

10. Indemnification

You agree to indemnify and hold harmless EasyPEPCheck, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Technical issues or outages
  • Circumstances beyond our control

12. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue the Service at any time. We may also update these Terms from time to time.

We will notify you of material changes via email or through the Service. Your continued use after changes take effect constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of France. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.

Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EasyPEPCheck regarding the Service and supersede any prior agreements.
